Official rules: North Pole Marathon entry giveaway

1. NO PURCHASE NECESSARY. Internet access is required to enter. The following promotion is intended for viewing and participation in the 50 United States, District of Columbia and Canada (excluding Quebec) only and shall be construed and evaluated only according to applicable laws of the United States and Canada. Do not proceed in the Contest website if you are not located in the United States or Canada (excluding Quebec) at the time of entry. Void in Quebec, Canada, and where prohibited, taxed or restricted. Contest begins at 12:00:01 a.m. Eastern Time (ET) on or about January 1, 2007, and ends at 11:59:59 p.m. ET on January 31, 2007 ("Promotion Period").

2. ELIGIBILITY: Open to legal residents of the 50 United States, District of Columbia or Canada (excluding Quebec) age 18 or older, or who have reached the age of majority in their state or province of residence (if higher than age 18) and who are located in the U.S. or Canada (excluding Quebec) at time of entry, except that employees, officers or directors of Enthusiast Group, LLC, YourRunning.com (collectively, "Sponsor"), their parent, affiliates, subsidiaries or their agencies or independent contractors who are engaged in the development, production or distribution of materials related to this Sweepstakes or the implementation of this Sweepstakes, and members of the immediate families or households of each of the above are not eligible to participate.

3. HOW TO ENTER: To enter: During the Promotion Period, follow the links at www.YourRunning.com ("Website") to the Contest Entry Application page, then follow the instructions to complete and submit an official entry. Once submitted, entry cannot be deleted, modified or canceled. All entries must be received during the Promotion Period. Limit one (1) entry per person. You may enter the contest under one name and one e-mail address only. Enter using only an e-mail address subscribed and registered in your name. In the event of a dispute about entries submitted by multiple individuals using the same e-mail account, entry will be deemed to have been submitted by the authorized subscriber of the e-mail account used to enter the contest at the actual time of entry. The authorized e-mail account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. If multiple entries are received from any person or e-mail address in violation of these Official Rules, all entries from that person will be disqualified. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Entries become the property of Sponsor and will not be returned.

4. CONDITIONS OF ENTRY: By submitting an entry, each entrant represents and warrants that his/her entry and materials submitted with the entry, in whole and in part: (i) are his/her original creation and have not been copied in whole or in part from any other work; (ii) do not violate or infringe any copyright, trademark, or other proprietary right of any person or entity; (iii) are his/her sole and exclusive property and (iv) are true and accurate in all respects. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries. Further, each entrant represents that he/she is physically fit and able to run a marathon of 26.2 miles at the North Pole in sub-zero weather conditions, and agrees to provide Sponsor with an affidavit of physical fitness and medical doctor’s clearance upon Sponsor’s request, if selected as the potential Grand Prize winner.

5. SELECTION OF WINNER AND WINNER OBLIGATIONS: All eligible entries received will be reviewed and judged by a panel of judges selected by Sponsor based on the following criteria: previous marathon experience (30%); cold weather running experience (30%); writing skills (30%); and experience with video and audio reporting (10%). In the case of a tie, the entry with the highest score in the writing skills category will be deemed the winner. In the event that there is still a tie, the entry with the highest score in the previous marathon experience category will be deemed the winner. All entries and participation in this contest shall be governed by these Complete Official Rules and the decisions of the judges, whose decisions shall be final, binding, and conclusive on all matters. Winners will be selected and notified on or about February 15, 2007. As a condition of claiming the Grand Prize, winner agrees to provide written, spoken and photographic coverage of the event and his/her training leading up to the event on YourRunning.com, in accordance with instructions and guidelines provided by Sponsor and without additional compensation. Specifically, winner agrees to:

  • (a) write a daily blog leading up to and during the 2007 North Pole Marathon, sharing his/her experiences training for and participating in the race;
  • (b) record a short weekly audio podcast leading up to the race and immediately after completing the race;
  • (c) shoot photographs and/or video of the race and his/her training sessions; and
  • (d) be available for written and/or audio interviews with YourRunning.com staff.

All materials created, developed, submitted or performed by winner shall be deemed a "work made for hire" and all right, title and interest thereto, including copyrights and derivative works and concepts or ideas depicted therein, shall become the sole and exclusive property of Sponsor, may be used by Sponsor for any purpose and in any media whatsoever (without further compensation or review), and will not be returned.

6. GRAND PRIZE (1): Entry for winner into the 2007 North Pole Marathon, including round trip coach air transportation from a major commercial airport located in Canada or the United States near winner’s residence to marathon departure site (currently planned for Moscow, Russia), round trip air transportation from marathon departure site to the North Pole camp, and five (5) nights' lodging (3 nights in marathon departure site city and two nights at marathon camp). Approximate Retail Value (ARV) $13,000 U.S/ $15,000 CDN. Actual value may depend on point of departure, and the difference between the ARV and actual value of the prize package will not be awarded. Runner Up (1): Runner up will receive the Grand Prize only in the event that the original Grand Prize winner fails, refuses or is unable for any reason to run in the 2007 North Pole Marathon, and this fact becomes known to Sponsor on or before March 15, 2007 (to provide adequate time to arrange for travel by the Runner Up). There is no separate Runner Up prize, and if the original Grand Prize winner runs in the marathon, or it becomes known to Sponsor after March 15, 2007, that he/she will not be able to run the marathon, Runner Up will receive nothing. All items or expenses not specifically mentioned as being included are excluded. All federal, provincial, state and local taxes, if any, and any other incidental costs or expenses not identified in these rules are the responsibility of the winners. All prizes are provided "AS IS" with no warranty or guarantee by Sponsor, either express or implied. Winner acknowledges that Sponsor is not a sponsor of the 2007 North Pole Marathon and is not responsible or liable for the conduct of the event or winner’s participation in the event. Participation in the 2007 North Pole Marathon is subject to the terms and conditions established by Polar Running Adventures, available at www.npmarathon.com. Important Notice: Trip must be taken on dates specified by Sponsor (currently planned for April 13-18, 2007, but subject to change). All reservations and travel arrangements must be made through travel agent selected by Sponsor and are subject to availability. Winner must confirm travel dates at least 30 days prior to departure. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. Blackout dates and other restrictions apply. In the event any activity included in the Grand Prize is cancelled, delayed or postponed for any reason, Winner will not be reimbursed, and Grand Prize shall consist solely of the remaining elements. Winner is solely responsible for obtaining a valid U.S. or Canadian passport and any other required travel documents. Sponsor is not responsible for lost or mutilated travel documents or tickets and none will be replaced.

7. CONDITIONS OF PARTICIPATION: Winner will be notified by phone, mail, e-mail or private delivery service (at Sponsor's sole discretion); and will be required to sign and return an Affidavit of Eligibility and Release of Publicity (where legal) and Liability Release, to be received within five (5) days of notification. In the event of noncompliance, if a winner cannot be reached at the e-mail or mailing address on that winner’s entry, or if a prize or prize notification is returned as unclaimed or undeliverable, that prize will be forfeited and an alternate winner may be selected in accordance with these Complete Official Rules. No cash or substitution of any prizes will be offered in whole or in part. No assignment or prize transfer is permitted in whole or in part. If a prize is unavailable, Sponsor reserves the sole right to substitute a prize of equal or greater value. All taxes, fees, and surcharges on prizes are the sole responsibility of each prize winner. By participating and accepting a prize, where permitted by law, winner grants to Sponsor (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Sponsor the right to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web, in perpetuity and throughout the universe, winner’s name, portrait, picture, voice, likeness, image, municipality of residence, statements about the promotion, and biographical information as news or information and for trade, advertising, promotional and any other purposes without any compensation or review.

8. RELEASE OF LIABILITY: All entrants agree to hold harmless and release Sponsor, its parent companies, affiliates, and subsidiaries; the service agencies and independent contractors of any of the above organizations; and their respective officers, directors, associates, agents (including advertising and promotion agencies), and all others associated with the development and execution of this Web site and contest from any and all alleged and actual claims, actions, and liabilities with respect to or in any way arising from this contest; participation in any contest or prize activities; or delivery, acceptance, use, or misuse of the prizes, including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), damage to property, and damage or loss of any other kind whether or not caused in whole or in part from the negligence of Sponsor (or its authorized third party). Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web-site users or by any of the equipment or programming associated with or used in the contest or by any technical or human error that might occur in the processing of submissions in the contest. Sponsor assumes no responsibility for any error; omission; interruption; deletion; defect; delay in operation or transmission; communications-line failure; or theft, destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines; computer online systems, servers, or providers; computer equipment; software; or failure of e-mail or entry on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participant’s or to any person’s computer related to or resulting from participating in this contest or downloading materials from this Web site. Sponsor is not responsible for user cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the contest or defraud Sponsor in any way will be prosecuted to the fullest extent of the law. Participants who engage in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the contest is not capable of running as planned, due to, without limitation, infection by computer virus, worm, or bugs; tampering; unauthorized intervention; fraud; technical failures; or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the contest.

9. DISPUTES: THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF COLORADO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this contest, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Colorado, having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this contest), and participant further waives all rights to have damages multiplied or increased.

10. WINNERS LIST: The names of Grand Prize winner be posted online at www.yourrunning.com no later than February 20, 2007, or you may request a Winner’s list by sending a self-addressed, stamped envelope to Enthusiast Group LLC, 2475 Broadway, Suite 300, Boulder, Colorado 80304.
